SB 492 requires IHCDA to prescribe the form for two notices that lenders must use to be in compliance with the provisions of SB 492, which takes effect July 1, 2009. FINAL versions of the Pre-Suit Notice and Settlement Conference Notice are now available here and on IHCDA’s website. Although the Authority has also provided instructions for completing and sending the two Notices, these are not to be construed as legal advice and do not replace or supersede the provisions of IC.
